These Terms govern your use of the Failure Point mobile application ("the app"). By downloading or using the app, you agree to these Terms.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own training. You may not copy, reverse-engineer, resell, or redistribute the app except as permitted by applicable law or the relevant app store's terms.

Purchases & subscriptions

The app offers in-app purchases, which may include a one-time unlock and/or auto-renewing subscriptions. Prices are shown in the app before purchase. Payment is charged to your Apple App Store or Google Play account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage and cancel subscriptions in your App Store or Google Play account settings. Refunds are handled by Apple or Google in accordance with their policies.

Not medical advice

Failure Point is a training logbook and provides general fitness information only. It is not medical advice and is not a substitute for professional guidance. High Intensity Training is strenuous. Consult a qualified physician before beginning any exercise programme, and stop if you experience pain, dizziness, or discomfort. You use the app and train at your own risk.

No warranty

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or that any data will be preserved.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law.

Changes

We may update these Terms as the app evolves. Continued use after changes constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of England and Wales.
